DMCA Policy

DataBazaar respects intellectual property rights and complies with the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512. If you believe content available on the Platform infringes your copyright, you may submit a takedown notice to our Designated Agent using the procedure described below.
1. Designated DMCA Agent

Note: This email address is only for DMCA notices. Other inquiries (support, general legal) sent to this address may not receive a response.
2. Takedown Notice Requirements
To submit a valid DMCA takedown notice under 17 U.S.C. § 512(c)(3), your written notice must include all six of the following elements:
- Identification of the copyrighted work — A description of the copyrighted work you claim has been infringed. If multiple works are covered by a single notice, a representative list is acceptable.
- Identification of the infringing material — A description of the material on the Platform that you claim is infringing, with sufficient detail to allow DataBazaar to locate it (e.g., the URL of the listing, dataset ID, or specific file name).
- Your contact information — Your name, mailing address, telephone number, and email address.
- Good faith statement — A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Accuracy statement — A statement that the information in the notice is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
- Signature — A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
Notices that do not include all required elements may be rejected or ignored. Be aware that submitting a false or materially misrepresentative DMCA notice may expose you to liability under 17 U.S.C. § 512(f).
Upon receipt of a valid notice, DataBazaar will expeditiously remove or disable access to the allegedly infringing content and notify the Seller who uploaded it.
3. Counter-Notice
If you are a Seller and believe your content was removed as a result of a mistake or misidentification, you have the right to submit a counter-notice under 17 U.S.C. § 512(g). A valid counter-notice must include:
- Your physical or electronic signature.
- Identification of the material that was removed and the location at which it appeared before it was removed (e.g., the dataset URL or listing ID).
- A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification.
- Your name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your district (or, if outside the U.S., any judicial district where DataBazaar may be found), and that you will accept service of process from the person who submitted the original takedown notice.

Upon receipt of a valid counter-notice, DataBazaar will forward it to the original complainant and restore the removed content within 10–14 business days, unless the complainant notifies us that they have filed an action seeking a court order to restrain you from engaging in infringing activity related to the material.
4. Repeat Infringers
In accordance with 17 U.S.C. § 512(i), DataBazaar maintains and enforces a policy for the termination of accounts of users who are repeat infringers.
A "confirmed violation" is a DMCA takedown where the Seller did not submit a valid counter-notice within the prescribed window, or where DataBazaar independently determined infringement occurred.
Three (3) confirmed violations will result in permanent account suspension. DataBazaar reserves the right to permanently suspend an account after fewer than three violations when the circumstances warrant (e.g., clearly willful, large-scale, or repeated infringement of a single rights holder's works).
